Bombak Distillery will, if requested by the Buyer, at the cost and risk of the Buyer, arrange for the delivery of Goods to the Buyer at the address nominated by the Buyer within Australia. Bombak Distillery does not ship goods internationally.
 

Goods will be dispatched by Bombak Distillery within 7 working days of order and payment (unless otherwise stated).
 

Risk in Goods sold by Bombak Distillery to the Buyer passes from Bombak Distillery to the Buyer upon despatch from the warehouse of Bombak Distillery. Bombak Distillery has no obligation to arrange for insurance of Goods against the risks of carriage.
 

If Bombak Distillery agrees to arrange freight and insurance, or both, in respect of any Goods sold or supplied by Bombak Distillery to the Buyer, the Buyer must pay and reimburse Bombak Distillery for all such costs.
 

Bombak Distillery shall not be liable for any loss or damage due to any failure by Bombak Distillery to deliver any Goods promptly, or at all.
 

Delivery dates or times indicated by Bombak Distillery to the Buyer are approximate only and do not constitute a guarantee of delivery or delivery by such date or time. No time of the essence transaction will be considered by Bombak Distillery unless agreed in writing by Bombak Distillery.
 

Subject to these Terms of Use, no Goods shall be placed on Back Order.
 

Goods may be placed on Back Order if agreed in writing by Bombak Distillery. Those Goods shall be supplied by Bombak Distillery as soon as reasonably practicable upon Bombak Distillery receiving those Goods.
 

Bombak Distillery may, in the sole discretion of Bombak Distillery, delay delivery of any Goods until Bombak Distillery has received payment from the Buyer of all money due by the Buyer to Bombak Distillery in respect of those Goods and any other Goods previously sold by Bombak Distillery to the Buyer.



 

The Buyer has no right to cancel, or vary, any order for Goods after Bombak Distillery has accepted that order.
 

If for any reason Bombak Distillery permits the Buyer to cancel an order for Goods, the Buyer must pay Bombak Distillery a fee equivalent to twenty five percent (25%) of the price for those Goods that would, apart from cancellation of the order, be payable by the Buyer to Bombak Distillery.
 

If Bombak Distillery accepts a return of Goods from the Buyer, any amount payable by Bombak Distillery to the Buyer as a result of that return of Goods is not payable in cash by Bombak Distillery to the Buyer, but may only be applied in reduction of the price payable by the Buyer to Bombak Distillery for future Goods sold by Bombak Distillery to the Buyer.
